JK Buick GMC, an Illinois-based automotive retailer, was accused of sending telemarketing texts to customers after they requested not to receive them anymore, per Top Class Actions.
The plaintiffs in the suit claimed JK Buick GMC violated the federal Telephone Consumer Protection Act (TCPA).
While the automotive retailer didn’t admit to any wrongdoing in the case, it agreed to a $130,000 settlement to resolve the claims and avoid further legal costs.
Terms listed in the JK Buick GMC TPCPA settlement confirmed that eligible claimants will get an equal share of the net fund.
ELIGIBILITY
There’s only one criterion class members need to meet to receive money from the settlement.
They must’ve continued to receive marketing messages from JK Buick GMC after requesting that the messages stop.
Those who did so and continued to get the texts will automatically qualify for payment.
No further action is required, such as filing a claim form.
PAYMENT AMOUNT
Eligible class members are expected to receive a one-time distribution totaling around $1,300 from the settlement fund.
It’s only an estimate, as the amount could vary depending on those participating.
The funds will be sent to claimants’ addresses, which can be updated through the settlement website if needed.
