California Woman Sentenced for Assaulting Toddler on Flight, Concurrent with State Arson Sentence
A 33-year-old California woman received a sentence of time already served and one year of federal supervision after pleading guilty to a misdemeanor assault charge on her two-year-old child aboard a flight. Breanna R. Mistler, from Davis, was taken into custody after the flight from Puerto Vallarta, Mexico landed at Sea-Tac Airport on May 1, 2024, according to a press release from the U.S. Attorney’s Office.
U.S. Magistrate Judge Brian Tsuchida handed down the sentence, which will be served concurrently with an upcoming four-month state sentence for an unrelated arson conviction set to begin in September. During today’s sentencing, Judge Tsuchida expressed his hope for Mistler to build "a more stable life" for her and her young child, as reported by the U.S. Attorney's Office.
In what the prosecution described as an extreme case of vulnerability, witnesses aboard the flight saw Mistler hit and shake her child, who was confined to the window seat with no way to resist or escape. Mistler admitted to the actions as part of her plea agreement, although she denies having kicked the two-year-old as some passengers had alleged.
Mistler's attorney, Dennis Carroll, pointed out at the sentencing that her client had reached "lowest point" and is now "sober, reflective and remorseful," with Mistler currently only being allowed supervised visits with her daughter. Mistler herself acknowledged her past setbacks and expressed a desire to improve, stating, "I hit rock bottom. I am a better person now. I want to continue to be better," as mentioned in the same press release.
Following her state sentence, Mistler will be under the supervision of federal probation officers, Child Protective Services, and California probation officers. She is also enrolled in parenting and anger management classes in an effort to prevent future incidents of similar nature.
